What is AI disclosure in real estate?

AI disclosure means telling buyers when a listing photo or video has been digitally altered or AI-generated in a way that changes how the property looks. Rules increasingly require a label on or next to the altered image and access to the original, unaltered version. Routine corrections that do not change the property (white balance, exposure, cropping) typically do not require disclosure.

What listing edits require disclosure?

Edits that materially change how the property looks: virtual staging, sky replacement or twilight conversion, object removal, landscape changes, enhancing fireplaces or water features, and AI-generated or AI-animated video. Standard photo corrections (color, exposure, lens distortion, cropping, sharpening) generally do not. Always confirm your MLS and state rules.

What is California AB 723?

California AB 723, effective January 1, 2026, requires that a digitally altered listing image include a label disclosing the alteration on or immediately adjacent to the image, and that the original, unaltered image be accessible to prospective buyers.
