New York DOS Guidance: Disclosure Requirements

The New York Department of State has warned that misleading AI-generated listing photographs may violate existing real estate advertising rules, even without a dedicated statute. Treat AI-altered New York listings as requiring disclosure.

Penalties & enforcement

The New York Department of State, Division of Licensing Services, disciplines real estate licensees under existing advertising rules (Real Property Law 441-c and 19 NYCRR 175.25) and can revoke or suspend a license, issue a reprimand, or impose a fine of up to $2,000 for dishonest or misleading advertising. New York has no dedicated AI-image statute or penalty yet.
